1.2 Sale of products through the Platform is carried out under the brand name 'Style Island' by Style Island Private Limited and which products are manufactured/packed by Concept Clothing Private Limited at the premises detailed in the tag/label attached with the products.
2 AVAILABILITY OF PRODUCTS
2.1 All product orders are subject to availability. Along this line, if there are difficulties regarding the supply of products or there are no more items left in stock, we reserve the right to provide you with information on substitute products of the same or higher quality and value that you may order. If you do not wish to order the substitute products, we will reimburse any amount that you may have paid.
3 BUYING PRODUCTS AS A GUEST
3.1 The functionality of buying products as a guest is also available on the Platform. Under this type of purchase, only such data which are essential to process your order will be requested from you. Upon completion of the purchase process, you will be offered the possibility of registering as a user or continuing as a non-registered user.
4 USE OF OUR PLATFORM
4.1 When you use the Platform and place orders through it, you agree to:
a) Use the Platform to make enquiries and place legally valid orders only.
b) Not to make any false or fraudulent orders. If an order of this type may reasonably be considered to have been placed, we shall be authorised to cancel it and inform the competent authorities.
c) Provide us with your email address, postal address and/or other contact details truthfully and precisely. You also agree that we may use this information to contact you in the context of your order if necessary.
d) If you do not provide us with all the information we need, you cannot place your order.
e) When you place an order on the Platform, you must ensure that you are over the age of 18 years and are legally eligible to enter into binding contracts.
5 RULES OF CONDUCT
5.1 We expect users of the Platform to respect the law as well as the rights and dignity of others. While using the Platform, you agree to comply with all applicable laws, rules and regulations. In addition, your use of the Platform is conditioned on your compliance with the rules of conduct set forth in this clause, and failure to comply with these rules of conduct may result in termination of your access to the Platform.
5.2 You agree, undertake and confirm not to host, display, upload, modify, publish, transmit, update or share any information on the Platform that:on of the purchase process, you will be offered the possibility of registering as a user or continuing as a non-registered user.
a) belongs to another person and to which you do not have any right to;

g) impersonates another person;
h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
i) threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;
j) is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
5.3 You further agree, undertake and confirm not to:
a) use the Platform or the services for committing fraud, embezzlement, money laundering, or for any unlawful and/or illegal purposes;
b) to reproduce, duplicate, copy, sell, resell or exploit any portion of the Platform;
c) use the Platform to harm or injure any third party;
d) forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Platform;
e) upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements);
f) upload, post, email, transmit or otherwise make available on the Platform, any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam", "chain letters," "pyramid schemes," or any other form of solicitation;
g) interfere with or disrupt the Platform or servers or networks connected to the Platform, or disobey any requirements, procedures, policies or regulations of networks connected to the Platform.
5.4 We reserve the right, but have no obligation, to monitor the materials posted on the Platform. Notwithstanding this right, you remain solely responsible for the content of the materials you post on the Platform. In no event shall Style Island assume or has any responsibility or liability for any content posted or for any claims, damages or losses resulting from use of content and/or appearance of content on the Platform.
5.5 Additionally, you acknowledge and agree that you are solely responsible for obtaining and maintaining all telecommunications, broadband, and computer hardware, equipment, and services needed to access and use the Platform, and for paying all charges related thereto.
6 TECHNICAL MEANS TO CORRECT ERRORS
6.1 In case you detect that an error occurred when entering your personal data during your registration as a user of the Platform, you can modify them in the section "My Profile/Account".
6.2 You will be able to correct errors related to the personal data provided during the purchase process by contacting the customer service as per the details provided on the Platform. The Platform displays confirmation boxes in various sections of the purchase process that do not allow the order to continue if the information in these sections has not been correctly provided. Also, the Platform offers details of all the items you have added to your shopping cart during the purchase process, so that before making the payment, you can modify the details of your order.
6.3 If you detect an error in your order after the completion of the payment process, you should immediately contact our customer service to correct the error.
7 REFUSAL TO PROCESS AN ORDER
7.1 We reserve the right to remove any product from the Platform at any time and to remove or modify any material or content from the same. Although we will always do everything possible to process all orders, there may be exceptional circumstances that force us to refuse to process an order after having sent the order confirmation. We reserve the right to do so at any time.
7.2 We shall not be liable to you or to any third party for removing any product from the Platform, or for removing or modifying any material or content from the Platform or not processing an order once we have sent the order confirmation in which case the order will be considered cancelled and all amounts paid will be refunded to you in full.
8 SHIPPING AND DELIVERY POLICY
8.1 Delivery services for the products offered on the Platform is available in India only. Except in extraordinary circumstances, we will endeavour to send the order consisting of the product(s) listed in each delivery confirmation prior to the date indicated in the delivery confirmation in question or, if no delivery date is specified, in the estimated timeframe as indicated in our Shipping and Delivery Policy.
8.2 If for any reason we are unable to comply with the delivery timeframe, we will inform you of that situation and we will give you the option to continue with the purchase, establishing a new delivery date, or cancel the order with full reimbursement of the amount paid. Keep in mind that we ship throughout the week, except Sunday and public holidays.
9 PRICE AND PAYMENT
9.1 The price of the products will be as stipulated at all times on the Platform, except in the case of an obvious error. Although we make every effort to ensure that the prices featured on the Platform are correct, errors may occur. If we discover an error in the price of any of the products that you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled and all amounts paid will be refunded to you in full.
9.2 We are not obliged to provide you with any product at the incorrect lower price (even when we have sent the shipping confirmation) if the error in the price is obvious and unmistakable and could have reasonably been recognized by you as an incorrect price.
9.3 The prices on the Platform includes Goods and Service Tax ("GST"), and any other applicable taxes but excludes delivery charges, which are added to the total price.
9.4 Prices may change at any time. However, except as stipulated above, the changes shall not affect the orders for which we have sent an order confirmation.
9.5 Once you have selected all products that you wish to buy, they will be added to your cart. The next step will be to process the order and make the payment. To that end, you must follow the steps of the purchase process, indicating or verifying the information requested in each step. Furthermore, throughout the purchase process, before payment, you can modify the details of your order. You are provided with a detailed description of the purchase process in the shopping guide. Also, if you are a registered user, a record of all the orders placed by you is available in "My Profile/Account" area.
9.6 Payment can be made by Visa, MasterCard, Affinity Card, PayPal and American Express ("Card") or by bank transfer such as mobile or internet banking or by UPI. You can also make the payment for your order by cash in home deliveries, however, this facility is subject to your locality falling within the home delivery area zone.
9.7 We use Razorpay to ensure payment is made safely and your Card details will be encrypted to minimize the possibility of unauthorized access or disclosure. Authority for payment must be given at the time the order is made. If payment is made via any other channel, extra amount as applicable will be charged upon confirmation of your order.
9.8 To minimise the risk of non-authorised access, your credit card/ debit card/ net banking (mobile or internet) details will be encrypted. Other than where payment is by cash on delivery, the payment will be due and payable immediately at the time of placing of the order.
9.9 When you click "Buy Now", you are confirming that the credit card is yours. Credit cards and debit cards are subject to verification and authorisation by the card issuing entity. If the entity does not authorize the payment (either by credit card / debit card / bank transfer), we shall not be liable for any delay or failure to deliver and we will be unable to conclude the sale contract with you.

However, Style Island cannot guarantee the accuracy of all information and materials and does not assume any responsibility or liability for the accuracy, completeness or authenticity of any information and materials contained on the Platform.
13.4 Style Island does not warrant that the operation of the Platform will be uninterrupted or error-free, or that the Platform is free from viruses or other components that may be harmful to equipment or software. Style Island does not guarantee that the Platform will be compatible with the equipment and software which you may use and does not guarantee that the Platform will be available all the time or at any specific time.
13.5 Due to the open nature of the Platform and the possibility of errors in storage and transmission of digital information, Style Island does not warrant the accuracy and security of the information transmitted or obtained by means of the Platform, unless otherwise indicated expressly on the Platform.
13.6 All product descriptions, information and materials shown on the Platform are provided on an "as is" and on an "as available" basis, with no express or implied warranties on the same, except those legally established. In this sense, if you are contracting as a consumer or user, we are obliged to deliver products that are in conformity with the contract, being liable to you for any lack of conformity which exists at the time of delivery. It is understood that the products are in conformity with the contract if they (i) comply with the description given by us and possess the qualities that we have presented in the Platform, and (ii) show the quality and performance which are normal in products of the same type and which can reasonably be expected. To the extent permitted by law, Style Island excludes all warranties, except those that may not be excluded legitimately.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Platform is inaccurate at any time without prior notice.
14.2 We undertake no obligation to update, amend or clarify information on the Platform or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied on the Platform or on any related website, should be taken to indicate that all information on the Platform or on any related website has been modified or updated.
15 INTELLECTUAL PROPERTY
15.3 You recognise and agree that all copyright, registered trademarks and other intellectual property rights on all materials or contents provided as part of the Platform belong to us at all times or to those who grant us the licence for their use. You may use said material only to the extent that we or the usage licensers authorise expressly. This does not prevent you from using the Platform to the extent necessary to copy the information on your order or contact details.
16 THIRD PARTY LINKS
16.1 If the Platform contains links to other websites and third-party materials, said links are provided for information purposes only and we have no control whatever over the content of those websites or materials. Accordingly, we shall not accept any liability for any damage or harm deriving from their use.
17 FORCE MAJEURE
17.1 Style Island shall not be held responsible for any damage, loss, non-availability of the Platform or its services, or any delay in the delivery of the products, or deficiency in provision of the Platform or its services, resulting directly or indirectly due to a fire, earthquake, flood, epidemic, lockdown, strike, lockout, labour unrest, riot, civil disturbance, war, civil commotion, act of God, act of terrorism, court order, change in law, or any other circumstance which is beyond the reasonable control of Style Island.
19.3 You agree that any termination of your access to or use of the Platform may be affected without prior notice and that Style Island may immediately deactivate or delete any user name and/or password used by or provided to you, and all related information and files associated therewith, and/or bar any further access to such information or files. You agree that Style Island shall not be liable to you or any third party for any termination of your access to the Platform or to any such information or files, and shall not be required to make such information or files available to you after any such termination.
20.1 You agree to indemnify and hold Style Island, its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from and against any costs, claims, charges, expenses, losses, damages or demand, including attorneys' fees, suffered by Style Island, relating to or arising out of:
b) your breach of any rights of other users of the Platform;
c) your use or misuse of the Platform or the services; and
d) your violation of applicable laws.
21 GOVERNING LAW AND JURISDICTION
21.1 The use of the Platform and the product purchase contracts through said Platform shall be governed by the laws of India.
21.2 Any controversy that arises or is related to the use of the Platform or said contracts shall be subject to the jurisdiction of the competent courts in India.
